Having completed the work included in item 1 above i.e. associated with the training scheme for misfuel remediation operatives, and the vehicle/equipment specification to be referenced within PAS43 guidance. The working group now moves on to item 2 and adjusts its participants to include, only those who directly operate vehicles and employ personnel that are used to carry out the task of misfuel remediation. The constitution of the working party for this stage is therefore as follows:-

The working group to comprise of the following (as a maximum):-
Note: for the purposes of this document, ‘representation’ shall be taken to mean - one or more people who attend meetings or participate in the working group as a sole operator, or on behalf of a company or organisation. However, in the event of a vote being taken, only one vote will be counted from each participating individual, company or organisation.
1 x Chairman of RFRS (Director of RFRS Limited). (Who shall have the casting vote in the event of a tie).
1 x Facilitator of RFRS (Director of RFRS Limited). (One vote)
1 x Representative from Safety Passport Alliance. (One vote)
Representatives from up to ten organisations/companies that directly manage and operate (own or lease), one or more vehicle which operate anywhere in the United Kingdom, that have been adapted to be used to recover mixed fuel from mis-fuelled vehicles into on-board tanks/containers, and who directly employ persons to operate the vehicles.
The maximum number of participant organisations or companies represented on the RFRS working group at any time shall be limited to 13.
A vote may take place only when no less than 7 individuals, organisations, companies and other voting eligible participants are present at a meeting.
Meetings may take place when less than 7 organisations/companies are present, they may be recorded and actions agreed when voting is not necessary.
As of 30th November 2016, the RFRS working group will be deemed to comprise of representatives from the following companies/organisations/individuals:-
Beyond 30th November 2016 any company or organisation wishing to join the RFRS working group may do so if there is a vacancy, and that they are proposed and seconded by current participants in the group as listed, and their participation shall be conditional on receiving more than half of votes cast from those present at a scheduled and recorded meeting of the group. The Chairman shall not initially cast a vote, but shall have the deciding vote in the event of a draw.
Advisors from companies and organisations that can be of advantage to the group, may attend meetings or make submissions to the group, but they do not have any right to vote. These may be experts in the fields of: Information Technology, Dangerous Goods Safety Advisor, Insurance Brokers or other relevant experts.
Other companies and organisations that are eligible to represented on the group may also contribute to the group (as some have in the past), however, they will not be eligible to vote.
In addition to voting being the method by which companies/organisations may join the working group, voting may be necessary to resolve other issues. For a vote to be taken, a motion must be proposed and seconded by listed participants of the group. The outcome will be decided in favour of the motion by receiving more than half of votes cast from those present at a scheduled and recorded meeting of the group. The Chairman shall not initially cast a vote, but shall have the deciding vote in the event of the numbers of votes for and against being even.
Participants individuals, (apart from the Chairman, Facilitator and SPA representative), companies or organisations undertake to contribute £200 per month towards the costs of the work of the RFRS during the time that they are listed as participating in the group. Safety Pass Alliance undertake to contribute £10 for every Misfuel Safety Passport that they issue. Participants may withdraw by giving notice to the Chairman at any time, however, will be liable for their contributions up until the date when the notice was given.
